BY BOOKING A TOUR WITH SEA SAN BLAS YOU AGREE TO THE FOLLOWING:
Waiver of liability for recreational activity, waiver of claims, and express assumption of risk and indemnity agreement.
Express Assumption of Risks Associated with Recreational Activities:
I hereby affirm and acknowledge that I have been fully informed of the inherent dangers and risks associated with the recreational activity generally described as an outdoor adventure tour, including equipment rental and transportation associated with such activity that I am about to undertake.
These risks include, but are not limited to:
- The risk of injury from water activities and equipment used for transportation is significant, including the potential for permanent disability and death.
- My own negligence and/or the negligence of others, including, but not limited to, vehicle and/or boat operator errors and decision making including errors in evaluating terrain, rapids, weather, trails and route location .
- This activity is performed outdoors and therefore includes risks associated with exposure to excessive heat, hypothermia, impact of the body against water, injection of water into body orifices, encounter with natural or artificial objects, exposure to animals with the consequent risks of kicking, biting, moving away, running away or moving unexpectedly and causing injury and/or death.
- Possible equipment failure and/or engine malfunction. .
- Accidents or illnesses that take place in remote areas where there are no medical facilities available.
- Tiredness, lightheadedness or faintness which may cause you to lose focus or diminish your reaction time, and therefore increasing the risk of an accident.
- Attack or encounter with insects, reptiles and/or animals.
*I understand that the description of these risks is not complete and that unknown or unforeseen risks may result in injury, illness, or death. I also accept SEA SAN BLAS' release of liability, waiver of claims and compensation agreement related to any of these risks. In consideration of being permitted to participate in the activities described above, I hereby accept, acknowledge and appreciate that.
Therefore:
I release the operators, their managers, supervisors, employees, representatives, agents and volunteers, and vessels from all liability and from any claim or cause of action that I, my estate, heirs, survivors, executors or assigns may have for personal injury, property damage or wrongful death arising from the above recreational activities, whether caused by active or passive negligence of the operators or otherwise.
By executing this document, I agree to hold the operators harmless and indemnify them jointly for any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the activities described herein.
By accepting this agreement, I have not required any oral or written presentation or statement made by the operators, beyond what is stated in this contract.
This release will be binding to the fullest extent permitted by law. If any provision of this release is found to be null or invalid, the remaining terms will apply.
I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND ASSUMPTION OF RISK AGREEMENT IN ITS ENTIRETY AND FULLY UNDERSTAND ITS TERMS, AND ACKNOWLEDGE THAT I HAVE WAIVED LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
BY PURCHASING A TRIP THROUGH SEA SAN BLAS, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD AND AGREE TO BE A PARTY TO THE ABOVE WAIVER.
